By accessing or using ArkCollect Cards("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time. Changes become effective when posted, and your continued use of the Service constitutes acceptance of the updated Terms.

ArkCollect Cards is a collectible AI character card application. Users collect ARK personality cards, earn Essence through activities and quests, open Mystery Boxes, complete themed collections, and upgrade cards through the Forge. The Service is provided for entertainment purposes.

A related AI social platform is available separately at social.arkcollect.com. You may use the same login credentials across ArkCollect services where supported.

To use the Service you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your credentials and for all activity on your account.

• You must be at least 13 years old (or older if required by your local law).
• You must not use the Service if you are prohibited under applicable law.
• We may limit features, regions, or availability at our discretion.

The Service includes virtual items such as cards, Essence, Memory Fragments, and Mystery Box openings. These virtual items:

• Have no real-world monetary value and cannot be exchanged for money.
• Cannot be purchased with real money (Essence is earned, not sold).
• Are non-transferable between players — there is no player-to-player marketplace.
• Are licensed to you for use within the Service, not sold or owned outright.
• May be modified, rebalanced, or discontinued as part of game updates.

Essence is internal currency earned through quests, daily activities, and sponsored content. Duplicate cards convert into Memory Fragments for that card. Box openings and collection mechanics are subject to published odds and game rules.

• We do not guarantee any specific card from box openings.
• Game balance, drop rates, and rewards may change with reasonable notice where practical.
• Sponsored quests and advertisements are clearly labeled as sponsored.

Pro is a paid subscription that provides cosmetic and quality-of-life benefits. Pro is not pay-to-win:

• Pro does not provide better box odds or Essence advantages.
• Pro benefits may include ad-free experience, badge, themes, filters, and early access.
• Subscription terms and pricing are displayed at checkout.

Payments for Pro membership may be processed by third-party payment providers. Where applicable, purchases may be handled by a Merchant of Record (such as Paddle) who may appear on your statement and handle taxes and invoicing.

Refunds are handled according to the refund policy displayed at checkout and any mandatory consumer protection laws that apply to you. Digital subscriptions may be non-refundable once delivered or used, except as required by law.

You agree not to use the Service to:

• Violate any laws or regulations
• Exploit bugs, glitches, or automation to gain unfair advantages
• Use bots, scripts, or unauthorized tools to interact with the Service
• Attempt to sell, trade, or transfer virtual items outside the Service
• Harass, threaten, or harm others
• Interfere with the Service, including security testing without authorization
• Create multiple accounts to evade limits, bans, or restrictions

ArkCollect retains all rights in the Service, card artwork, ARK identities, names, likenesses, underlying technology, and related intellectual property. You receive a personal, non-transferable, revocable license to use virtual items within the Service. You may not copy, redistribute, or commercially exploit Service content without permission.

We may suspend or terminate your access to the Service if we believe you have violated these Terms, pose a risk to the Service or other users, or if required by law. You may stop using the Service at any time and may delete your account where functionality is provided.

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, secure, or error-free. Use the Service at your own risk.

To the maximum extent permitted by law, ASKING GALAXY SRL and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability for any claim will not exceed the amounts paid by you (if any) for the Service in the twelve (12) months preceding the event giving rise to the claim.

These Terms are governed by the laws of Romania, without regard to conflict of law principles, unless mandatory consumer protection laws in your country provide otherwise.
